1. Agreement to Terms
These Terms and Conditions (the "Terms") govern your access to and use of DOMUS (the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

3. The Service
DOMUS provides tools for residential communities to manage operations, announcements, events, bookings, documents, requests, visitor entries, vendors, and communications. The Service includes a web portal for community managers and a mobile application for residents.
4. Eligibility and Accounts
- You must be at least 18 years old (or the age of majority in your country) to use the Service.
- You must provide accurate, current, and complete information and keep it updated.
- You are responsible for all activity under your account and for safeguarding credentials.
- You must notify us immediately of any unauthorized use or security breach.
5. Community Roles
Communities are managed by authorized administrators and staff ("Managers"). Managers are responsible for configuring community data, inviting residents, and administering access. Residents use the Service through invitations tied to their community and, where applicable, their unit. Managers are responsible for ensuring that community data and invitations are accurate and lawful.
Manager Responsibility and Authority: Managers represent and warrant that they have the legal authority to manage the relevant community, including the right to invite residents, process community data, and administer access to the Service. DOMUS does not verify ownership, tenancy, or legal relationships between community members. DOMUS does not validate the legal authority of managers or verify resident identities.
6. License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal community management purposes, subject to these Terms. No source code or ownership rights are transferred.
7. Acceptable Use
- Do not use the Service for unlawful, harmful, or fraudulent activities.
- Do not attempt to access accounts or data you are not authorized to access.
- Do not upload malicious code or disrupt the Service.
- Do not impersonate any person or entity or misrepresent your affiliation.
- Do not reverse engineer, copy, or resell the Service.
- Do not scrape, crawl, or use automated means to access the Service without our explicit permission.
8. Content and Data
You retain ownership of content you submit. You grant us a limited license to host, process, and display content solely to provide and improve the Service. You are responsible for ensuring you have the rights to submit content and that it complies with applicable law.
We may generate analytics and aggregated insights derived from usage data. These insights are anonymized and do not identify individuals.

11. Subscriptions, Billing, and Taxes

- Payments are processed through Paddle as Merchant of Record.
- Taxes, VAT, or similar charges may be applied where required.
- Fees are non-refundable except as required by law or specified by Paddle policies.

12. Availability and Support
We aim to keep the Service available, but we do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. Support is provided via official channels and subject to reasonable response times.
13. Suspension and Termination
We may suspend or terminate access if you violate these Terms, fail to pay fees, or use the Service in a way that creates risk or legal exposure. You may terminate your account at any time.
Subscription Enforcement: If a subscription expires, is canceled, or payment fails, access for residents may be restricted or suspended until payment is resolved. Managers may retain limited access for administrative and renewal purposes.
Upon termination, access to the Service will end, and certain data may be deleted in accordance with our Privacy Policy and applicable law.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of Costa Rica, without regard to conflict of law principles. Any dispute shall be brought in the competent courts of San Jose, Costa Rica, unless a mandatory consumer law in your country requires otherwise.

We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, internet failures, third-party service outages, government actions, or labor disputes.
